The creator of legal functionalism, Oliver W. Holmes, claimed that “the life of the law has not been the logic; it has been experience”. The most important for the functionalists was “law in action” and not “law in books”. Holmes was of the opinion that the science of law should be concerned with prediction of future court rulings when he wrote that “the prophecies of what the courts will do in fact, and nothing more pretentious, are what I mean by the law”. Other precursor of legal functionalism, John Ch. Gray, believed that law is what judges deem to be law in judicial decisions. Jerome Frank, a representative of legal realism, believed that the subject of a lawyer’s analysis should be not so much court rulings themselves but the decision-making process as investigated in the psychological aspect.
My professional experience allows me to accept the above views. I completed my law studies in 1991, graduating from the Nicolaus Copernicus University of Toruń where I studied under the supervision of one of the most outstanding Polish civil law experts, Prof Mirosław Nesterowicz. In fact, it was not long before I could enjoy the fruits of my thesis supervisor’s hard work devoted to develop my lawyer’s personality. I was awarded the First Degree Award for the best MA thesis for my dissertation “Transformation of State-Owned Entities” which I defended in 1991 at the Department of Law, Nicolaus Copernicus University of Toruń. After completing my law studies, I concerned myself with the practical aspects of the international trade law, providing legal assistance to corporate entities in Switzerland (Lugano) and Italy (Milan and Bergamo).
In 1996 I started my lawyer training that was concluded with the exam taken before the District Council of Lawyers in Bydgoszcz in the year 2000 which I passed, receiving a very good mark.
Since the year 2001 I have worked as a lawyer based in Bydgoszcz. Key areas of my practice include civil liability for loss, protection of substantive rights, execution of rights by parties to civil agreements, matrimonial property relations, liability of state authorities as well as penal and legal implications of civil relations. Furthermore, I provide legal assistance to citizens of English-speaking countries in legal matters presented e.g. by the U.S. Embassy in Warsaw or the Australian Embassy in Poland.
